Charge can’t change, says Spector trial judge

AP: The jury in Phil Spector’s trial is still locked in that ol’ 7-5 impasse. The judge is not going to let them consider a lesser charge to give them an easy time…
“I do accept that it would be inappropriate at this time to instruct the jury with a new offense, that being the lesser offense of manslaughter, because I believe it’s basically directing them, if at all possible, that’s what they should find. And that is inappropriate,” Superior Court Judge Larry Paul Fidler told attorneys.
He had earlier ruled that the jury would only consider the second-degree murder charge. The case, clearly, continues.
