This photo surely reminds us of a highlight of the trial: Dianne Ogden, testifying back in May this year. Revisit the memory here. No mention made of whose hair that actually is, because it looks suspiciously like Spector’s “Busy Mom” number…Anyway, what’s new in deadlocked jury land??

The jury’s 7-5 impasse at the end of last week compelled the judge to rescind this instruction:

That instruction said that in order to convict Spector the jury had to find that “the defendant must have committed an act that caused the death of Lana Clarkson,” and it specified the act was pointing a gun at her, which resulted in the gun entering her mouth while in Spector’s hand.

The judge decided that the instruction misstated the law by unduly limiting possibilities that the jury could consider. He gave a new instruction that included examples of inferences the jury could draw from the evidence, including the possibility that Spector forced Clarkson to place the gun in her own mouth and it went off.

Spector can’t be convicted of murder if he aided, abetted or encouraged Clarkson to commit suicide.

No evidence yet on whether he called the Samaritans helpline. While a gun entered someone’s mouth on the other side of the room. It could happen.
